According to our friends at French Health Issues, there has been a dramatic change in the position of the French Health Ministry regarding those on E106’s who have run out.
In essence, the letter of 23/01/08 from Roselyne Bachelot-Narquin (Ministère de la Santé, de la Jeunesse et des Sports) to the British Ambassador in Paris has conceded that all early retired in active non French Europeans who were legally resident in France on or before 23/11/07 will be allowed to join or stay in CMU, irrespective of their “E” form status. |

“I will simply return to the UK when I need treatment”, is a common statement we are hearing at the moment. It is possible in some cases, but the majority will find it problematic for the following reasons:
Overseas visitors entitlement to NHS hospital treatment... 1. Entitlement to NHS hospital treatment is based on residence in this country. Nationality or the past or present payment of income tax or National Insurance contributions is irrelevant when establishing residence. Anyone who is deemed to be ordinarily resident in the UK is entitled to free NHS treatment. |
